These Terms and Conditions (“Terms”) govern your access to and use of the service (the “Service”) provided by the operator of this workspace (“we”, “us”, “our”). By creating an account, placing an order, uploading video, or accessing any report, you agree to these Terms.

1. The Service

We provide race video handling and performance analysis, including delivery of generated reports and performance metrics. Some outputs may be produced using automated analysis (including computer vision and AI-assisted processing).

2. Accounts and eligibility

  • You must provide accurate account details and keep them up to date.
  • If you are acting for an athlete (including a minor), you represent that you have authority to do so (as a parent/guardian or otherwise authorised person).
  • You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.

3. Athlete information and authority

You may submit athlete profile details (e.g., name, date of birth/age, category, club/team) to ensure reports and footage are matched to the correct athlete. You must only provide athlete data you are authorised to share.

4. Orders, delivery, and access

  • Orders may include race/order details (meet, event, heat, lane, stroke/distance, order ID, selected tier).
  • We will deliver generated reports in the format offered at the time of purchase (for example, a PDF or web report page) and may provide accompanying metrics.
  • Access to reports and footage may be limited by roles/permissions and relationships recorded in our access controls.

5. Uploads and acceptable use

When you upload race footage or other content:

  • You must have the rights/permissions to upload and share it with us for processing.
  • You must not upload content that is unlawful, infringing, or that violates any person’s privacy or other rights.
  • You grant us a limited licence to store, process, reproduce, and transform the content solely to provide and improve the Service (including generating reports, thumbnails, screenshots, and derived analysis outputs).

6. Reports, metrics, and limitations

  • Reports and performance metrics are analytical estimates derived from video and available inputs and may contain errors.
  • The Service is provided for informational and training purposes only and is not a substitute for professional coaching or medical advice.
  • We may refine methodologies over time; results may differ between versions.

7. Support and communications

We may collect and retain support messages (including emails and complaint details) to provide customer support and resolve disputes. We may send service-related emails/notifications (for example, delivery notices, status updates). Marketing communications are only sent based on your marketing preferences and applicable law.

8. Payments, billing, refunds, and disputes

  • Payments are processed via our payment provider (e.g., Stripe). We do not store full payment card details.
  • Billing details may be collected for invoicing and tax/GST purposes.
  • Refunds and disputes are handled according to the refund policy and applicable consumer law. We may request information to investigate disputes (including order details, support correspondence, and relevant evidence).

9. Privacy, data collection, and retention

We collect and use personal information to operate the Service, deliver reports, provide support, maintain security, and meet legal obligations. Examples include:

  • Account details (name, email, auth ID, phone)
  • Athlete profile details to correctly match footage and reports
  • Race/order details to identify the correct race and fulfil orders
  • Race footage and associated metadata to generate reports
  • Generated reports and performance metrics as deliverables and longitudinal history
  • AI/computer vision outputs (e.g., tracking points, confidence scores, error flags) for report generation and QA
  • Technical logs and app analytics for security and product improvement
  • Consent records (including timestamps and IP address) to evidence authorisation and acceptance

We retain data according to operational needs and legal requirements. Indicative retention periods include:

  • Account details: while active + up to 2 years after closure
  • Race/order and billing/payment records: typically 7 years
  • Race footage: typically up to 5 years after last athlete activity (order or login)
  • Generated reports: typically up to 7 years after last athlete activity
  • Performance metrics: while account exists; after closure typically 7 years
  • Technical logs: typically ~90 days (up to 6 months for investigations)

10. Intellectual property

The Service, its software, templates, and analysis methods are owned by us or our licensors. Subject to these Terms and payment (if applicable), you receive a personal, non-transferable licence to access and use delivered reports for your own purposes.

11. Suspension and termination

We may suspend or terminate access if we reasonably believe:

  • your use is unlawful or violates these Terms,
  • you are not authorised to provide athlete data or footage,
  • or it is necessary to protect the Service, other users, or our legal rights.

12. Liability and consumer guarantees

To the maximum extent permitted by law, we exclude warranties not expressly stated in these Terms. Nothing in these Terms limits rights you may have under applicable consumer protection laws that cannot be excluded. Where liability cannot be excluded, our liability is limited to the extent permitted by law.

13. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be communicated through the Service or by email where appropriate. Continued use after an update means you accept the updated Terms.
